Affordable Connectivity Program Terms and Conditions
By checking selecting yes on the Order Form and proceeding with this order, I acknowledge and agree with the following Affordable Connectivity Program Terms and Conditions:
Certification.
I certify that the information I provided in my application for the ACP supported service from WeLink is true to the best of my knowledge.
Sharing of Information.
The Affordable Connectivity Program (ACP) is a Federal Government broadband subsidy program that reduces my broadband internet access services bill. By enrolling in the program, I am authorizing WeLink to share my personal information and the personal information of any person I identify as the Benefit Qualifying Person with the Universal Service Administrative Company (USAC), the administrator of the federal ACP, including by uploading this personal information into USAC’s National Lifeline Accountability Database (NLAD) and National Eligible Verifier (National Verifier), and other government entities and their agents, as necessary to enroll, maintain, and support this program or as described in our privacy policy. This information includes, but is not limited to, the full name, phone number, email address, date of birth, last four digits of social security number, tribal ID (if applicable), Application ID of the National Verifier, eligibility criteria and status of myself and the person I identify as the Benefit Qualifying Person; and my ACP benefit amount and service rate, service dates, and service address. I understand that the information being transmitted to ensure the proper administration of the ACP I will not be able to participate in the ACP if I do not consent to sharing this information.
ACP Credit.
If I qualify for and enroll in the program, the federal Affordable Connectivity Program Credit (“ACP Credit”) will apply to the monthly charges for my WeLink Internet service up to the ACP Credit amount. The maximum ACP Credit is $30 per month, or $75 per month for service on Tribal lands. I am still responsible in full for any portion of my bill not covered by ACP Credit. My time participating in the ACP with WeLink will count towards the duration of any promotion or term contract.
Confirming Initial Eligibility and Termination.
I understand that WeLink does not determine my eligibility for the ACP. WeLink will use the information I provide to them to verify my eligibility to participate in ACP with the National Verifier and, if verified, enroll me in NLAD if possible. For my initial verification and enrollment, my service contract with WeLink will be terminated if WeLink cannot verify my eligibility with the National Verifier or enroll me with NLAD. WeLink will send me a notice if this occurs. I will not be subject to any fees or charges if my contract is terminated in this manner.
Non-Payment.
During the ACP, if I fail to pay any amount due, I understand that my WeLink Internet service tier may be downgraded to a tier that is fully covered by the ACP Credit for the duration of the ACP and that I may be restricted from upgrading or adding services until any such amounts have been paid. I also understand that my WeLink service may be terminated after 90 days of non-payment for the portion of my bill applicable to those services while my household receives the ACP Credit.
Length of ACP Credit.
The ACP subsidy and resulting ACP Credit will continue for as long as the Federal Government funds ACP and I remain eligible for the program and continue to be enrolled with WeLink as an ACP customer. After ACP is over, or if I am no longer eligible for the program, or if I transfer my ACP Credit to another provider, or if I de-enroll from ACP, my ACP Credit with WeLink will terminate, and I agree and consent to my WeLink Internet service continuing, and that I will be responsible for full payment at the then-current rates, terms, and conditions applicable to my service.
WeCare.
The WeCare discount identified in my order form is a promotion offered by WeLink. In addition, after ACP is over, or if I am no longer eligible for the program, or if I transfer my ACP Credit to another provider, or if I de-enroll from ACP, my WeCare discount with WeLink will terminate, and I agree and consent to my WeLink Internet service continuing, and that I will be responsible for full payment at the then-current rates, terms, and conditions applicable to my service.
Termination Fees.
I may change or cancel my service at any time during or after I am enrolled in ACP. If I am on a term contract while I am enrolled in ACP, I will not be charged any applicable Early Termination Fee for the duration of the applicable term. NOTWITHSTANDING THE FOREGOING, I ACKNOWLEDGE AND AGREE THAT I AM STILL RESPONSIBLE FOR RETURN OF EQUIPMENT AS SET FORTH IN THE WELINK HOME BROADBAND INSTALLATION AND SERVICE AGREEMENT, AND FAILURE TO DO SO, MAY RESULT IN FEES AS SET FORTH THEREIN.
Non-Usage.
If WeLink does not collect a monthly fee from me, I must use my WeLink provided services at least once every 30 days to remain eligible for the ACP Credit. If I do not, WeLink will notify me and I will have a 15 day cure period starting after they 30 day non-usage period. My ACP credit and WeLink services will be terminated after the expiration of the 15 days if I did not use my Welink internet services.
Reverification.
I understand that I may be required to re-verify my eligibility for ACP during the program. If am no longer eligible, the ACP Credit may no longer be available to me and other discounts WeLink offers through ACP eligibility, and I agree and consent to my WeLink Internet service continuing, and that I will be responsible for full payment at the then-current rates, terms, and conditions applicable to my service
Transferability and Household.
The ACP Credit can only be applied by one provider for any given month and is not transferrable to another individual or household. I understand that only one ACP supported service is permitted per household and certify that no other member of my household is receiving an ACP supported service.
Transfer of Services.
I understand that I can apply my ACP Credit to the participating broadband provider of my choice and to any broadband service offering of a participating provider (including WeLink) at the same terms available to households that are not eligible for ACP-supported service. By enrolling in ACP through WeLink, I understand that I am consenting to apply the ACP Credit to my qualifying WeLink services and authorizing WeLink to transfer my ACP Credit from another provider if I am already enrolled in ACP. By transferring my ACP Credit to my WeLink services, I understand that my ACP Credit will no longer be applied to services received from another provider and I may be subject to the other provider's undiscounted rates if I elect to maintain service from that provider. I understand that I may only transfer my ACP Credit to another provider once per service month with limited exceptions. I understand that if I later decide to apply my ACP Credit to services received from another participating provider, I will no longer receive the ACP Credit through WeLink, any credit received during the month of transfer will be reversed, and I will be responsible for full payment at the then-current rates I acknowledge having received this information and give my informed consent as of today’s date to transfer my ACP Credit from any other provider to WeLink.
Complaints.
Complaints against providers participating in ACP may be filed with the Federal Communications Commission's Consumer Complaint Center by calling 888-225-5322 or electronically at .
Order of Precedence.
In case of a conflict between these Affordable Connectivity Program Terms and Conditions and the WeLink Home Broadband Installation and Service Agreement, these Affordable Connectivity Program Terms and Conditions shall prevail.
